Eligibility Criteria for Subclass 309/100:
- Relationship: You must be in a genuine and continuing relationship with your partner, who is either an Australian citizen, permanent resident, or eligible New Zealand citizen.
- Marriage or De Facto: You must be legally married or in a de facto relationship for at least 12 months before applying.
- Sponsor: Your partner must be willing to sponsor you and provide support during your stay in Australia.

Partner Visa (Onshore) Subclass 820/801
The Partner Visa Subclass 820/801 is for individuals already in Australia who wish to apply for a partner visa while staying onshore. Similar to the offshore process, the Subclass 820 is a temporary visa that allows you to stay in Australia while the Subclass 801 permanent visa is being processed. If granted, the Subclass 801 permanent visa allows you to remain in Australia indefinitely.
Eligibility Criteria for Subclass 820/801:
- Relationship: You must be in a genuine and committed relationship with your partner, who is an Australian citizen, permanent resident, or eligible New Zealand citizen.
- Marriage or De Facto: You must be legally married or have been in a de facto relationship for at least 12 months.
- Sponsor: Your partner must sponsor you for at least 2 years while your application is processed.
- Current Visa: You must hold a valid visa while applying for the Subclass 820 visa and remain in Australia during the application process.
- Health and Character: You must meet the health and character requirements.

Pathway to Permanent Residency
Both Partner Visa categories offer a direct pathway to permanent residency in Australia. After holding the temporary visa (Subclass 309 or 820) for at least two years, if the relationship is ongoing, you may be eligible to apply for the permanent visa (Subclass 100 or 801).
